I am still assuming the accident wasn't your fault but...
Is mitsu really liable for anything if the car is out of warranty and has been tracked?
If there was an electronic failure, electronics can wear out just like mechanical parts... They can't be guaranteed forever surely?
And if there was some catastrophic mechanical failure, like the diff jamming, can the computer be expected to know what to do?
You say it braked AND accelerated? It sounds to me like AYC tried damn hard to keep the car straight, and didn't necessarily malfunction. But the AYC is designed for AWD... I doubt it has any sub-function or contingency for having unresponsive wheels...
If it was just a tyre blow-out and AYC freaked out then that'd be a different story, AYC shouldn't nearly kill you over something that normal.

I had a wheel speed sensor malfunction on the track and was violently thrown off the track on a corner. then I went back twice not knowing what was wrong... same thing happened twice more.
so if a sensor can do that - maybe a blowout where the wheel spins slower all of a sudden might do the same thing.
but a loud bang - could be rear diff let go or jammed somehow?

A part of the issue is that all sorts of different electrical/computer circuits are coming together, integrated for (normally) a safe driving experience. If one component in those sub-systems were to malfunction or experience some fault, it can have drastic, and in this case, disasterous consequences.
The brake assist system applies full braking power when it interprets a panic/emergency situation. The ABS system merely ensures wheel rotations are approximately equivalent so no sudden changes in rotational speeds. Perhaps a sudden change in rotation speed as reported by a wheel sensor attached to the wheel experiencing the puncture/blow out caused the system to experience conditions outside of its programming... I can only guess what they car intended to do to right the situation.
Good luck with the legal battle(s). And wishing you a speedy recovery. Has this experience put you off Evo X or Mitsubishis in general?

im interested to see the results of the finding of this ... this could have massive implications if what u are is true ? , on the manufacture, and the police ? ... not doubting your version of event at all ... if it were the falut of the car them u may have a claim on mitsuibishi, one for the recovery of the car and two for your health and well being .... this is going to be interesting i shall be following

Mind = Blown. I cannot believe what I just read and thank god you and your mates are alright.
How the F could they give you a neg driving ticket if your going the speed limit I mean don't they send out the forensic team to check the accident scene and determine where the traction was lost... I mean they can prove the speed just by looking at the tyre marks... Friken incredible and if you were pushing the brake why the hell didn't asc kick in I thought that overwrote everything (albeit till stuff snapped).
Good luck man, hope you get a result and a 100% conclusive review happens so every other evo owner knows how to avoid it in the future. Thank god I don't have AYC.

I must not be familiar with the laws then. I thought negligent driving was when your doing something that could cause harm to yourself and others and an accident was just... well a accident. I've been rear ended twice does that count as neg driving regardless? Not being a smart a** I truly want to know
