All OEM induction systems are legal as they have to pass ADR.
The reason it can be counted as illegal to use a POD is that in Victoria at least it is illegal to modify the pollution control on a vehicle. Theoretically any modification to intake or exhaust can be classified as a modification to Pollution Control Systems it just depends on how strict the Police want to be.

it is an enclosed box, the bonnet makes up the rest of the enclosure making it fully enclosed from the engine bay.

see the rubber moulding around the top, that will rest against the bonnet. The bonnet will most likely have a plastic moulding on it.
the EVO and RA K&N typhoon SRI have a similar set up with and open enclosure but when the bonnet is down it creats an enclosure
Do you know where I'd be able to find out more info on that? I have the Injen SP1899P (i.e. their SRI) for my Evo and heard something similar to this from Sean (spareparts). Just would like to have some more info in case I did get pulled over by the cops.
On another note, I found this for sale and was wondering if it would help reduce the chance of getting defected even if only for the fact it covers the pod filter element a bit >
