From 1 July, the following demerit point system will apply for unrestricted licence holders:

* 1 to 10kmh over the speed limit: one demerit point and an $84 fine;
* 11 to 20kmh over the speed limit: three demerit points and a $197 fine;
* 21 to 30kmh over the speed limit: four demerit points and a $338 fine;
* 31 to 45kmh: three month suspension, five demerit points and a $647 fine;
Over 45kmh: six month suspension, six demerit points and a $1,744 fine.

Get f**ked is what I'm thinking right now.

FIRST: It starts at 1kmph over. I can guarantee you right now, it doesnt. They have to give a certain leeway between 5 and 10% for manufacturing discrepancies in the incar speed measuring devices (speedometer) and the patrol unit's speed detection devices (LADAR's etc).

SECOND: wtf is with the fines? Can't they make it an easy 100, 200, 400, 700 or whatever?

THIRD: Massive increase from first to second bracket in terms of points. For example: Queensland is

7-13k's over: 1 point (dont ask me to remember fines)
14-20ks over: 2 points
21-30k's over: 3 points
31-45k's over: 4 points
46k's+ over: 8 points and bye bye license.

I think thats right anyway.

I think 1-10km/h is a crap range; the old "up to 15km/h" was a much more useful measure because if you're only 5km/h over the speed limit at say, 100km/h, that's not really significant/material and alot of the time it can happen if there was a sudden change in the incline/slope when driving.

As for the fines being random numbers- I'm also a big fan of round numbers but I think it's to do with the way that penalties in the past have been calculated using something called 'penalty units'. Not sure if it applies to NSW RTA but for some other fines/penalties (typically for corporations), to cater for inflation, the penalty is defined in terms of penalty units (e.g. offence XX attracts 2 penalty units, offence ZZ attracts 5 penalty units) and then penalty unit is defined separately as a dollar amount (e.g. $50) and can change over time by a fraction to cover for inflation/other adjustments.

It actually is quite a fair new system they are implementing compared to the old demerit points tier for speeding. Under the current tier, 0-15kph attracts 3 demerit points. So given how common speed cameras are now it means too many people were losing the license for going a few kph over the limit (4 times in 3 years will do it for a full license holder). I still think though they could have made the 11-20kph 2 points and the 20-30kph 3 points, but I guess what they are trying to do is slow people down whilst allowing some leniancy for the minor 0-10kph speeding offences. Here a 30kph over earns you a suspended license and 45kph over gets you a 6 month suspension. However I am told that if you get done for 46kph+ depending on the area and cop you'll quite possibly also get charged with an offence aswell as the speeding infringement (can't remember the name but its like a wreckless driving which will wind you up with a court hearing).

One thing they haven't mentioned much about (but if you read the RTA site it's there) is that green P platers will now lose a minimum of 4 points for any speeding offence. This means now that 2 minor speeding offences will mean you lose your license for reaching 7 points. Whilst this doesn't apply to me I think it's crap to take the license off a P plater for once or twice being caught 0-10kph over the limit. I believe the same should apply to them as it does for us full license holders.

Oh and if you think NSW is bad go to victoria where 25kph over will get you a suspension!

EDIT: Yes Jace the RTA does base their fines off setting a certain number of penalty units to each offence I believe.

1-10kph is quite a fair range I think. I certainly would rather this system than the older one.

I should also add Josh LIDAR and fixed speed cameras have very low margins of error, whilst vehicle mounted radar and mobile speed cameras are a little bit less accurate and generally they'll give more leeway. In saying that HWP generally won't book you for being only a 5-10kph over the limit. They generally like to go for the 15+ tickets. However with the new system they'll probably be more keen to nab people for 10+.

I know few weeks back I wasn't paying attention and ended up doing bit over 70 past a HWP cop on LIDAR duties in a 60 zone, I shit myself as soon as I saw him in the shadows and the red light pointing at me, thought I was gone but he didn't pull me over All I can assume is he wanted a 75+ and what a friend has said who is a cop would seem to back this up.

But yeah if you're speeding and get caught, suck it up and take it on the chin You got no one else to blame but yourself....

I am a firm believer in doing the wrong thing wherever possible
but at the same time, I accept all responsibility associated with that.
If I get caught speeding, I will not make an excuse, because I was speeding, and I did the wrong thing and I got caught. Cop it on the chin (Pun not intended)

I do beleieve they should allow for the margin of error, as A Crappy Affair and Crap Today and Crap tonight TV shows have shown us (Besides their undying ability to make news crap, make stuff people don't really care about a nationwide talk back item, and to exagerate their own spin on unsupsecting persons on the show) a lot of fixed cameras are way out on their speed detection and only seem to be in place at major spots where the government can try and pay it's unsurmountable debt from Injecting Rooms.

Speed camera's should be put near accident blackspots, near schools as a deterent, and finally outside parliement house, because they are a bunch of hypocrites...
