i was already in the left lane before i got halfway through the intersection, seriously a quarter of my car probably crossed the lines of the right lane from what i remember and i remember seeing it flash when i was already in the middle of one of the going straight lanes.
hopefully a bit of common sense and discretion will provail in this case as i cant do another suspension of my license, especially when i wasnt doing anything which was wreckless or dangerous

This. Unless you crossed further back over broken lines then its illegal.
However I don't know if they can actually hand out different kinds of fines with red light cameras.
I wouldn't say you're in the wrong if you did it safely, but the law will say you are...
I've actually been flashed by a fixed speed camera at an intersection and not gotten the fine. No idea why, as I was in the wrong and was going straight through so it would've been a clear photo.
Or maybe a cop will see it and go 'lolwut' and toss it out when they see you were going straight.
So maybe you get lucky.

The lovely people in the red light infringements area are only looking for red light infringements, if the photo doesn't show a red light infringement, the digital photos are marked as such and archived away. They don't care for any other offences. They only look for confirmation of a red light offence. The camera go off for various circumstances (they're not fool proof) so it required a level of human eyes to double check.tadz0rz wrote:taken from the vic roads website re lane markings:

I reckon you still need to complete the right turn even if you change your mind. You cannot move to the other lane to go straight instead. You can possibly contest if you're booked for beating the red light as you went straight on green and not turn right on red as the camera is intended to do. If ever you're able to get away with the red light fine, you still might get done for the illegal lane change (unsure if there are demerits for this).

i really hope your right pete because its put my mind at ease a little bit.
given that my mate did the exact same thing as me, but just found out it was somewhere else on the way home, ill have a bit of backup if i do need to contest this. thankfully one of my other mates saw this happen so we will have a witness as well
if i ran a red light which was for the going straight lane, fine id cop it on the chin and that would be the end of it but the fact is that i didnt run a red light for a turning lane which is the purpose of the camera in that intersection, i proceeded straight when i was in the going straight lanes.
should be an interesting one this....

apologies for sounding negative mate but i reckon u hav to prepare for the worst. once they found out that ur license has been suspended before, u can throw the discretion scenario out. they will classify u as repeat offender. they wont hesitate to send u those fines.
discretion applies more on full license first time offender.

Technically, you did not run a red light so you shouldn't be fined for such offence. I'm not sure though if the law permits them to use the photo as evidence for the illegal lane change.
